By accessing and using BotDynamics services, you agree to be bound by these Terms and Conditions of Use. If you do not agree with any part of these terms, you should not use our services.

These terms apply to all users of our services, including but not limited to: AI Agents, Inbox Central®, Kortex AI, WhatsApp Calling, chatbots and any other service provided by BotDynamics.

2. Description of Services

BotDynamics provides an enterprise automation platform that includes:

• Autonomous AI Agents: Advanced conversational artificial intelligence
• Inbox Central®: Unified multichannel messaging platform
• Kortex AI: Analysis and query assistant for administrators
• WhatsApp Calling: Integrated voice and video calls
• Custom Chatbots: Conversation automation
• Integrations: Connection with CRM, ERP and other systems

3. User Registration and Account

3.1 Registration Requirements

To use our services, you must:

• Provide truthful, accurate and complete information
• Be over 18 years old or have legal authorization
• Maintain the security of your account and password
• Immediately notify any unauthorized use

3.2 Account Responsibility

You are responsible for all activities that occur under your account. BotDynamics will not be responsible for losses arising from unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Uses

You may use our services for:

• Legitimate communication with customers and users
• Business process automation
• Operational data analysis
• Customer support and automated service

4.2 Prohibited Uses

It is prohibited to use our services for:

• Sending spam or unsolicited messages
• Illegal or fraudulent activities
• Violation of intellectual property rights
• Distribution of malware or malicious content
• Harassment, threats or offensive content
• Identity theft
• Reverse engineering of our systems
• Intentional overload of our servers

5. Intellectual Property

5.1 BotDynamics Rights

All intellectual property rights over the platform, software, design, content and technology are the exclusive property of BotDynamics. This includes:

• Source code and AI algorithms
• Trademarks and logos
• Documentation and training materials
• Interface design and user experience

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable and revocable license to use our services in accordance with these terms.

6. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy. By using our services, you accept the processing of your data in accordance with said policy.

We implement enterprise-level security measures, including end-to-end encryption, to protect information processed through our systems.

7. Plans and Billing

7.1 Service Plans

We offer different service plans with varying features and prices. Specific details are provided at the time of contracting.

7.2 Payments

• Payments are processed securely
• Fees are charged in advance according to the contracted plan
• Prices may change with 30 days prior notice
• No refunds for services already provided

7.3 Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period.

8. Service Availability

8.1 Service Level

We strive to keep our services available 24/7, but we do not guarantee uninterrupted availability. We may:

• Perform scheduled maintenance with prior notice
• Temporarily suspend service for technical reasons
• Modify or discontinue features with prior notice

8.2 Technical Support

We provide technical support according to the contracted plan. Response times vary according to priority and service plan.

9. Limitation of Liability

To the maximum extent permitted by law:

• BotDynamics will not be liable for indirect, incidental or consequential damages
• Our total liability will not exceed the amount paid for the service in the last 12 months
• We do not guarantee specific results from the use of our services
• We are not responsible for content generated by users or third parties

10. Indemnification

You agree to indemnify and hold harmless BotDynamics from any claim, loss or damage arising from:

• Your use of the services
• Violation of these terms
• Violation of third party rights
• Content you provide or transmit

11. Modifications to Terms

We reserve the right to modify these terms at any time. Modifications will be effective upon posting on our website.

Continued use of our services after modifications constitutes your acceptance of the new terms.

12. Termination

12.1 By User

You may terminate your account at any time by contacting us.

12.2 By BotDynamics

We may suspend or terminate your access if:

• You violate these terms
• You fail to pay applicable fees
• Your use puts our systems or other users at risk
• Required by law

13. Governing Law and Jurisdiction

These terms are governed by the laws of Mexico. Any dispute will be submitted to the exclusive jurisdiction of the courts of Mexico City.

14. General Provisions

• Severability: If any provision is invalid, the others will remain in force
• Waiver: Failure to exercise a right does not constitute waiver
• Assignment: You may not assign these terms without our consent
• Entire Agreement: These terms constitute the entire agreement between the parties
